Conditions for Website Use
ALL USE OF THE WC Technology Solutions WEBSITE, ITS SERVICES, AND ANY SERVICES OFFERED THROUGH THE SITE (COLLECTIVELY, THE "SITE") IS SUBJECT TO THE TERMS OF THIS AGREEMENT AND THE POLICIES, AGREEMENTS AND INSTRUCTIONS FOR THE USE OF THIS SITE CONTAINED IN THE SITE AND POSTED BY
WC Technology Solutions WHICH ARE HEREBY INCORPORATED HEREIN.
Satisfaction Guarantee for Services
WC Technology Solutions guarantees that users of its services receive full value for their money. While in most cases this means solving the user's problem, there may be instances in which the problem is not resolved. In such cases the user may not be billed.
Limitation of Liability
(A) In no event shall WC Technology Solutions be liable to any person for any special, general, incidental, indirect, consequential, or punitive damages of any kind, including, without limitation, those resulting from negligent or criminal acts of third parties, loss of use, loss of data, lost profits, or computer hardware damage, in connection with any of its services, the TechSquadLive.com website (including all information, services, and products that are referenced or linked to in the WC Technology Solutions website), or any other information, documents, products, software, downloads, repair services, advice, and information provided by WC Technology Solutions or any of its third-party product or service providers, whether such person is advised of the possibility of such damages.
(B) WC Technology Solutions RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED REMOTE SERVICES AND INSTEAD REFUND YOUR PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY WC Technology Solutions.
(C) Force Majeure: In the event WC Technology Solutions delivery of the Services is delayed, prevented, or otherwise made impracticable by reason of any acts of God, fires, floods, earthquakes, or other natural catastrophes; national emergencies, strikes, lockouts or other labor difficulties; computer "hacking" attack or computer virus; any law, order, regulation or other action of any governing authority; power outages, technical equipment failures, or any other cause beyond WC Technology Solutions reasonable control, then WC Technology Solutions shall be excused from such delivery to the extent that it is delayed or prevented by such cause.
(D) To the extent permitted by law, you agree that WC Technology Solutions total liability for damages related to its services is limited to the total amount you pay for the services, and you release WC Technology Solutions from liability for any indirect, incidental, special, or consequential damages. WC Technology Solutions IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA IF YOU TRY TO FIX ANY COMPUTER OR SERVER OR NETWORK ISSUES WITHOUT OUT KNOWLEGE OR IF YOU INSTALL IN ADDITIONAL SOFTWARE OR HARDWARE WITHOUT OUR KNOWLEDGE OR IF YOU.
(E) Data Protection: You agree and understand that it is your (the customer's) responsibility to maintain copies of all important data on your computer, and to obtain such copies prior to authorizing WC Technology Solutions to commence its services for you.
(D) Transfer or Installation Services: Unless otherwise agreed, WC Technology Solutions is not liable for and you agree to hold WC Technology Solutions and owner of WC Technology Solutions harmless from any and all damages, costs, and expenses incurred as the result of any defect or damage to any software or data residing or recorded in your computer, whether incurred during the course of WC Technology Solutions services or otherwise. If service involves transferring information or installing software, you represent that you have the legal right to copy the information, to use the software and agree to the terms of the software license, and you authorize WC Technology Solutions to transfer the information and accept such terms on your behalf in performing the service.
REMOTE SERVICES
General Services: WC Technology Solutions will attempt to diagnosis your technology problem, provide an estimate of applicable service fees (plus applicable taxes), and then provide you with a technology solution over the telephone or via the internet. In certain cases, however, problem diagnosis and support may not be completed because of a problem with your computer or its configuration that is beyond our control.
Remote Support Services: Remote support services may be offered to you over the telephone or via the internet if your PC was built within the last four years, you have a working cable or DSL high speed internet connection, and your operating system is Windows 98SE or newer. If you elect to receive remote support, then WC Technology Solutions remotely logs on through your high-speed internet connection to view your computer desktop from the WC Technology Solutions Covert Operations Center. WC Technology Solutions stays in contact with you to keep you fully briefed on every step of the process as your technology problem is resolved. Remote support may involve the installation of software on your computer that will allow WC Technology Solutions to provide the remote support services. By electing to receive remote support, you agree to allow WC Technology Solutions to use whatever tools deemed necessary to repair your computer, including remote access. You understand that if remote access is used on your computer there will be no residual software from the remote session; however, there may be a text file placed on your computer that will explain the work that was done on your computer. If such a text file is placed on your computer, you have the option to either save the file for future reference or to delete it from your computer.
Services and Diagnostic Fee.
WC Technology Solutions will perform all necessary services reasonably necessary to properly complete the repair of your computer or system.
Payment
Once service is complete, your payment for the actual costs incurred and the final sum owed, is due upon completion. Should it be determined in the course of the performance of diagnostics that the problems on your computer are hardware based, WC Technology Solutions will notify you of same and you may take or send the hardware to a repair station of your choice or to WC Technology Solutions, for service on the hardware; diagnostic fees may still be applicable. No adequate estimate of that expense can be determined without actually testing the hardware.
Right of Refusal
WC Technology Solutions reserves the right to refuse, suspend or terminate any of its services to any user in its sole discretion, without notice. Reasons for refusing service include, but are not limited to: using computer system fraudulently, illegally, or for propagating libelous or otherwise defamatory, obscene, pornographic, abusive, harassing or threatening material.
CONFIDENTIALITY
You will keep confidential all information supplied by us and we will keep confidential all information supplied by you.
Internal Complaint Policy Statement
We are committed to your satisfaction and have procedures in place to provide you with a fair, timely and effective means to resolve problems with any transaction. We record and monitor all complaints. We will undertake to acknowledge any complaint within seven business days of receipt and will strive to address and resolve any complaint within 45 days of receipt. In the event we cannot reach a satisfactory resolution, we are committed to using third-party dispute resolution services through the Better Business Bureau of United States of America.
